RULES AND REGULATIONS
OF
TIKI VILLAGE MOBILE HOME PARK

Effective January 1, 2016, the Rules and Regulations of Tiki Village Mobile Home Park will be revised to read as follows:
General Regulations

  1.  It is the specific policy  and intent of Owners that this park be designed, operated and maintained for the use and benefit, and to meet the social and physical needs, of persons 55 years of age or older.  As such, every resident of the park must be an adult.  “Adult” for purposes of these rules means 55 years of age or older, or other person over age 40, sharing residence with a resident 55 years of age or older.  Notwithstanding this express policy and intent to the contrary, Owner reserves the right to accept a resident who is less than 55 years of age but older than 40, as long as at least 80% of the occupied homes in the park, including that of the new resident, are occupied by at least one person over the age of 55 years of age or older.
  2. Anyone desiring to purchase a mobile home in the park or otherwise move into the park must fill out an application, submit to a background check and be approved by Owner.  Owner in its sole discretion reserves the right to approve or disapprove all applicants based on tenant history, criminal history, failure to meet minimum age requirements, character, false or misrepresented information,  intentional withholding of relevant background information, credit worthiness, background check results and /or information indicating that the person may pose a threat to the life, health, safety or property of the park residents or employees or the peaceful enjoyment of the mobile home park by its residents. Further, Owner reserves the right to refuse admittance to anyone.
  3. Applications, lot leases, background checks and all preliminary documents required by Owner must be completed and approved prior to the occupancy of a mobile home.  Only the family to whom the lot is rented may live on the lot without prior written consent of the Owner.
  4. All owners of a mobile home in Tiki Village shall sign a written lease agreement for residency within the Park, and are bound by all terms and conditions of the lease, Prospectus, Chapter 723, Florida Statutes and these Rules and Regulations by virtue of their occupancy in Tiki Village MHP, regardless of whether a written lease has been signed.
  5. Tenants shall conduct themselves in a manner that does not unreasonably disturb their neighbors or constitute a breach of peaceful enjoyment of the park by its residents, and shall ensure that all guests conduct themselves in a similar manner.  No loud parties or other disturbances, such as radios, TVs, musical instruments at a high volume, etc. will be allowed at any time.
  6. Residents are “NOT” permitted to sell their mobile home, with the promise of occupancy, unless the buyer is approved by Owner and agrees to all rules and regulations.  Owner must be notified in writing within at least 10 days of accepting an offer to sell his or her home.  Tenant shall at the same time also furnish a completed rental application package to Owner, so that Owner may conduct the appropriate screening of the proposed purchaser.  Sale of a mobile home by a tenant is subject to the prospective buyer applying for and being approved to become a tenant in accordance with the Lease, Park Rules and Regulations and Chapter 723 Florida Statutes, if the mobile home is to remain in the park.  If someone other than the prospective purchaser will be occupying the property after purchase, the prospective purchaser must also furnish relevant information regarding the occupant for screening purposes
  7. No pets of any kind except for certified service animals are permitted within Tiki Village MHP.  Tenants are responsible for cleaning up after any service animal, controlling the animal and prohibiting the animal from causing any harm or disturbance to other residents in the community.  Tenant is also liable for any damages to person or property caused by the service animal in the park, and shall indemnify, defend, save and hold Owner harmless against any and all claims relating to damages caused by a service animal.
  8. Residents shall not assign this Lease or any interest therein, and shall not sublet the leased premises or any part thereto, or allow any other person or persons who are not listed above to reside in, stay in, or otherwise occupy or use the leased premises without the specific, written consent of the Owner.  Overnight guests are required to register at the office upon arrival and are limited to visiting the park for no more than fourteen (14) consecutive or non-consecutive days and/or nights in any forty five (45) day period or a fee of $50 per night shall be imposed.  Prior written permission and background checks consistent with paragraph 2 above are required for guests visiting the Park beyond the previously stated time period.  Permission is to be granted or withheld in Park Managements sole discretion and is also subject to occupancy limits for each lot.  If any children visit your lot, you must properly supervise and control them, and agree to indemnify, defend, save and hold Owners harmless against any and all claims for damages to person or property that occur in connection with the activities of said children.  Further, children may not play on lots where residents don’t welcome them, and shall comply with all provisions of the lease, Prospectus, Rules and Regulations and Chapter 723, Florida Statutes relating to disturbing the quiet and peaceful enjoyment of the community by other residents.
  9. No business, commercial enterprise or soliciting shall be permitted to operate within the park and no signs of advertisement may be erected on the resident’s lot or mobile home without Owners approval.  However, For Sale signs are permitted on a mobile home lot, subject to prior management approval.
  10. To avoid disturbing or disrupting other residents and guests, the residents and guests are to confine the consumption of any and all alcoholic beverages to the private confines of their homes or porches.  No alcohol shall be consumed in the recreation or common areas or facilities.
  11. All tenants shall provide prior written notice to Management when leaving for the summer or vacating the Park for an extended period of time.  Such notice shall be delivered to the Office at least 14 days prior to the departure, shall specify the expected time period of absence and shall provide contact information in case of any issues relating to the tenancy during the tenants absence.
  12. Tenants shall obey all traffic regulations and comply with all posted traffic signs while within the community.  The use or display of any firearms, air rifles, slingshots, bows and arrows, spears, blades (outside appropriately used kitchen utensils and lot maintenance items or equipment)  BB guns, pellet guns, fireworks, explosives or any other weapon or dangerous item is prohibited.
  13. Any act which endangers the life, health, safety, property or peaceful enjoyment of the park or its residents is a violation of the rules of the park and is grounds for eviction.
  14. The Rules and Regulations are subject to amendment from time to time.  All tenants will receive written notice of amendments at least 90 days prior to the effective date of the amendment.
  15. Additional rules and regulations governing recreational facilities and park activities may be posted in such area from time to time and must be observed by everyone.
  16. All Rules and Regulations shall be observed by recreational vehicle tenants pertinent to their occupancy and are to acknowledge written receipt of such rules and regulations prior to their occupancy.
  17. Additional fees are as follows:
    a. Boat Trailer or other vehicle storage
    b. Lawn Maintenance Fee
    c. Guest Fee
    d. Third Tenant Fee
    e. Late Rent Fee       
  18. SPECIAL EXEMPTIONS.  The park owners reserve the exclusive, unrestricted right to grant special exemptions to the rules when in the exclusive opinion of the park owner, special circumstances warrant the granting of special exemptions or written Waiver of a particular provision as it applies to a particular resident or residents so long as such an exemption or waiver does not interfere with the general welfare, health and safety of the other residents of the park.  Residents are responsible for keeping themselves informed of any noticed change in the rules.
  19. Lot rental rates are the amount charged for two or fewer resident per home or recreational vehicle.  Current rates will be posted in the office for any approved third resident.
  20. Tenants and their guest shall be generally courteous and respectful of the rights of all other tenants and guests to use and enjoy the parks common areas and common facilities in the Park.  No person shall engage in any conduct whatsoever that causes a threat to the life, health or safety of any other person in the community.  Nor shall any person engage in any activities that are disruptive or disturbing to other persons in the community.  Tenants and their guests shall comply with all applicable local, state and/or federal laws while occupying or otherwise using common areas and common facilities in the Park.
  21. Neither the Park Owner nor any officers, directors, agents, employees or representatives of the Park Owner shall be liable for any claims, damages or losses of any kind or nature with regard to any agreed upon lot or lawn maintenance, the storage of any personal property in storage areas or facilities; and/or the use, occupation or enjoyment of the common areas and common facilities.  The Park does not provide security or safety personnel and the use of any common areas and common facilities shall be at the user’s sole risk.
  22. Any and all requests for accommodation(s) shall be submitted in writing and shall be accompanied by supporting documentation signed by a relevant health care professional on a form or forms provided by or acceptable to Park Management .  Such supporting documentation must verify the existence of a condition that requires the requested accommodation in accordance with applicable state or federal law or act.  In the event that approval of a caregiver is being requested, the caregiver must submit an application for residency to be evaluated in accordance with Park Rules and Regulations, along with qualifications for providing such services.  Certified service animals must be current on their vaccinations and proof of current vaccinations must be furnished with any related request for accommodation.  Please note that you are not being requested to inform Park Management of the specific condition serving as the basis for any request for accommodation.
